Kwote cannot provide the service without processing the data about you and other Kwote members. Processing the data you share with Kwote is essential to the services which Kwote provides and a necessary part of our performance of the agreement we have with you.
These "terms of service" contain provisions that govern how disputes between you and Kwote are resolved. These include an agreement to arbitrate, which will, unless you are a resident of the European Union, with limited exception, require you to submit claims you have against Kwote to binding and final arbitration and limit you to claims against Kwote on an individual basis unless you opt-out following the instructions below.
The services provided by Kwote are intended for persons who have a minimum age of 13 years old or such higher age required in your country to use the services. When you are under the legal age to form a binding contract in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these terms of service on your behalf.

When you register with Kwote, you agree that Kwote may use your personal information that you access or use and as otherwise outlined in these terms of service. Suppose you provide any personal information that is not correct or not current, or Kwote has a reasonable ground to suspect that such personal data is inaccurate or not current. In that case, Kwote has the right to suspend or terminate your account and refuse current or future use the services.
You are solely responsible for maintaining the confidentiality of the login associated with your account and for restricting access to your password and mobile device while logged into the Kwote services. You accept responsibility for all activities that occur under your account or from your mobile devices. We cannot guarantee the absolute security of your account, your content, or the personal data provided by you. We cannot promise that our security measures will prevent third-party hackers from illegally accessing the Services or its contents. You agree to immediately notify Kwote of any unauthorized use of your account or password or any other breach of security, and confirm that you understand all risks of unauthorized access to Member Data and any additional information or content you provided to Kwote.
You can register for or login to your Kwote account via a third-party network, such as Google or Apple. You with this authorize Kwote to pre-populate the registration and other relevant information fields of your account and to use such third-party credentials to log you into your account.
To pay any fee, you need to designate and provide information about your preferred payment method. When you submit your payment information, you authorize Kwote and specific third-party payment processors to receive, store and encrypt your payment information. If you paid through the Google Play or iTunes store, you might change your payment method through the corresponding store account. Kwote will not provide refunds or credits, other than as outlined in these terms of service. If your payment provider discovers that there are fraudulent charges on your account resulting from use of your payment method at the Kwote services, please contact us immediately via [email protected].
To access premium functionalities of the Kwote service, you need to pay membership fees. Fees, together with additional required taxes, will be paid on a monthly or annual basis. All premium service fees are payable in advance. Members that will change from monthly to yearly premium memberships will have the annual rates take effect at the beginning of the next billing date. When you upgrade your premium membership, you will start a new billing date. You agree to pay the premium membership services charges, and other fees you incur in connection with your Kwote account, whether on a one-time or subscription basis. Kwote reserves the right to increase the services charges, any associated taxes, or to institute new fees at any time upon reasonable advanced notice.
Premium membership charges will be billed automatically at the start of the billing period. These charges will auto-renew until you terminate your premium membership. Your premium membership charges will be the same as your initial charges unless we otherwise notify you in advance. You can terminate your premium membership at any time, as you can read below.
When you are a resident of any country outside of the United States, you may be entitled to change your mind and receive a full refund within fourteen days. The cooling-off period only applies when you have not logged in or redeemed or started to use the services as a premium member during the cooling-off period.
When you signed up via Google Play or iTunes store, you can cancel your premium membership by downgrading through the corresponding store. The cancellation of your premium membership will go into effect at the end of your billing cycle. When you cancel your premium membership your account will still be active and become a free membership. You can renew your premium membership at any moment without opening a new account. Premium membership charges may have increased.
You are the owner of the information, data, text, software, sound, photographs, graphics, video, messages, posts, tags or other materials you make available in connection with the Kwote services.
You grant Kwote a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to: use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform and display any Content and any name, username or likeness that you post on or in connection with the Kwote services. These apply to all media formats and channels now known or later developed without compensation to you. The license will end as soon as you delete your content on your account.
You understand that you and not Kwote are entirely responsible for all the content that you upload, post, email, transmit or otherwise make available via the Kwote services. Kwote does not proactively and routinely screen or monitor the material posted to the services by others. Therefore we don't guarantee the accuracy, integrity or quality of such content. Kwote may screen, monitor, refuse or remove any content that violates the terms of service or is otherwise unacceptable. You accept that using the Kwote services, and you may be exposed to content that is offensive, indecent or objectionable. Kwote will not be liable in any way for any content, or any loss or damage of any kind incurred as a result of the use of any content made available on the Kwote service. You do agree to bear all risks associated with the use of any content made available in connection with the Kwote services. These may include the reliance on the accuracy, completeness or usefulness of such content.
You do agree that Kwote is not in any way responsible for and does not endorse content posted on the Kwote services. If your content does violate these terms, you may bear legal responsibility for that content. As between you and Kwote, any material is non-confidential and non-proprietary and will not be liable for any use or disclosure of content. You do acknowledge and agree that your relationship with Kwote is not confidential, fiduciary or another type of special relationship. The decision to submit content does not place Kwote in a position which is different from the position held by other members of the general public, including the once about your content. Kwote will not be liable for any use or disclosure of any content you provided.
You permit Kwote to use your profile name and information about your activities and actions you have taken, including your use of third party products, services, devices, in ads, offers and other commercial contexts on the Kwote services without compensation to you.
We expect you to honour the Kwote standards. Kwote's services are for your personal use only. You are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell for any commercial purpose any portion of the services.
